CVS comma files in the attic and directory

I have a CVS repository for production, which is already several years old, and noticed that it has files with the same names both in the attic and in the actual directory for this location. This seems like a mistake.

My question is how this can happen in the first place and what CVS will do if duplicate files exist.

My assumption (hope) is that it will ignore the Attic version all the time when there is a non-Attic version. Can anyone confirm that CVS behaves well all the time for this situation.

By the way, this error was noted by cvs2svn, as I am in the process of a "new" version control system.

This problem arises because someone crashes into the CVS repository (i.e. not through the cvs client). Unfortunately, such a trick is common, for example, to circumvent the limitation that CVS does not allow to rename files. Perhaps someone tried to rename the file by moving its file FILENAME,v, without noticing that the file name was used earlier in the project history and, therefore, already had the file Attic/FILENAME,v.
