Can I use images from Google results on my website?

I plan to create a module for my directory that will retrieve images from a user's website using Google Image Search in this scenario:

  • User logs in to his account
  • Enter the URL of your website
  • Sample application requests from a domain cached by Google
  • The application displays N number of images from the site, offering to associate them with its profile
  • Upon confirmation, the application will copy the images to my server

Can I do this and will it infringe any copyrights?

UPDATE

I assume that the user-created account in my business directory is the owner of this website (it is specified in the Terms of Use) and as the owner to whom it refers to its website. The application will display thumbnails and receive the original image from its website using links from Google results. What is the difference?

Disclaimer: IANAL

As long as you use only thumbnails between 80 and 200 pixels in size, this is considered fair use . I also recommend linking the image to the original page and mentioning somewhere that the images may be copyright material.

Like Facebook, you can use images to link to these websites. You should mention that these images may be protected by copyright. Google caches content. And the image search reads: "The image may be subject to copyright"
