Software Licensing: Open Source, No Commercial, No Derivatives

I know that I open a can of worms, but I got stuck after several days of research.

I am looking for an open source project software license. (Another website content management tool, but it’s not).

I want to free the source with the following:

  • allow free use of software (individuals and companies).
  • free use of results (this is a website)
  • make personal changes
  • lack of public distribution of the original or modified version
  • attribute of the original author
  • free of charge for consultations or services based on software or derivative versions

Since I wrote the code based on my own professional experience, I would not want my hard work to be done by a related company (previous employer) and used on a commercial basis. I would be glad if companies or individuals used my software for their website.

GPL and MIT allow you to "sell." Creative Commons advises against using your software license.

You might want to take a look at POV-Ray licensing. There is an end-user license, a distributor license and a modification license , all of which seem to combine to allow distribution of the source, but without blurring the POV-Ray brand or disassembling the code. Keep in mind that Debian has a “non-free” repository. you cannot be considered open source.

What you are describing sounds like “Freeware with Source included” to me. This is a less common form of software distribution, but it does exist. I know this form, especially from Delphi VCL components, maybe this is the point to start looking for a usable license, which you can possibly change to fit your own requirements.

But in order to be truly safe from the legal side, you must meet with a lawyer. Software license models are not lightweight material ...
