Sencha Touch (not Touch Charts) has 3 licensing options

  • Commercial software license (now free!) This is a good option if you are creating proprietary applications and you do not want to distribute and distribute the source code of your application with your users. You can create an unlimited number of applications with NO per place or for user payments.
  • OEM Commercial License (Paid License) This is a good option if you want to use Sencha Touch to create your own commercially licensed SDK or mobile app developer. Because use cases can vary widely, commercial OEM licenses are customizable for each customer.
  • Open Source License Sencha is an active proponent of open source software. This is a good option if you are creating an open source application with a license compatible with the GNU GPL v3 license. Although GPLv3 has many terms, the most important thing is that you must provide the source code of your application to your users so that they can freely modify your application for their needs.

Details are available here.

Regarding Touch Charts, here's what they say when you download the current beta:

Sencha Touch Charts will be available as an add-on to Sencha Touch for paid advertising or the GPLv3 license. During our beta period, Sencha Touch Charts is free to evaluate in the short-term beta license.

Functionally, they are the same. The difference is licensing.

Also not free.

The open source version is free and allows you to distribute your applications licensed under the GPL or compatible license.

The commercial version is not currently free, actually, but let you distribute your application as a private source.

See here http://www.sencha.com/products/touch/license/ for more details.
