I try to play audio in the background, but as soon as I insert the <audio> element on the page, the background music on the iPhone stops. I am wondering if there is a solution for this via HTML5, or if I have to go through my own and create another plugin to play my sound and turn off the background sound.

As far as I know, you cannot do this. Even using the web audio API in iOS 6, as soon as you start playing the audio buffer in the browser, iTunes pauses immediately.
