The application is rejected for the use of the icon, which is a "trademark of Apple",

I was simply denied the App Store for this reason:

Weve looked at your application and decided that we cannot publish this version of your iPhone application on the App Store due to the Apple brand image.

You may not use the Apple logo or any other graphic symbol, logo or icon owned by Apple on or in connection with websites, products, packaging, manuals, promotional / advertising materials, or for any other purpose than as written Apple's trademark license, such as a reseller agreement.

Now I believe that the image-infringer is one that, however, is clearly NOT an iPhone, and it helped you find your friends' phones around you. My artist painted it, this is not an iPhone.

There is nothing you can do about it. You must reconfigure the icon so that it does not look like Apple alone.

If you have an image similar to the iPhone in it, I can almost guarantee you that the reason was rejected. I remember reading a book in which a guy developed an application with an iPhone image in it and was refused. My suggestion is to use something else until it is connected with Apple, and I bet that everything will be fine.
